CREDITORS' RIGHTS AND COLLECTIONS

Kaplan, Bogue & Cooper's Commercial Collections Department provides comprehensive, attorney-managed debt recovery services to our clients, which range from some of the nation's largest financial institutions to some of the smallest financial institutions and businesses.  Our thorough understanding of the law, business, and the collections process, makes us much more than collectors. We are negotiators, investigators, collectors and litigators that have a proven track record for our clients.

We collaborate with each client and devise a collection strategy tailored to each client’s unique recovery objectives. Our attorneys selectively employ a range of collections tools to effectively achieve the desired outcome, including demand letters, pre-suit collections, credit bureau reviews, litigation, garnishment, skip tracing, asset searches, post-judgment collections and collateral recovery.

Our collections department maintains policies and practices compliant with all applicable federal and state governing laws and regulations, including the Fair Debt Collection Practices Act (FDCPA). Particularly important in today’s regulatory environment, Kaplan Bogue & Cooper’s Collections Department regularly tailors its practices and procedures to implement the specific compliance requirements of its clients. BANKRUPTCY

Combining substantial experience with original thinking, Howick, Westfall & Kaplan's bankruptcy attorneys have forged a national reputation. Our organization, experience and technological capabilities enable us to handle a large volume of consumer bankruptcy cases efficiently and cost-effectively.

Our real estate, lending & transaction attorneys focuses on structuring and closing commercial lending transactions. Our services include negotiation and documentation of forbearance, modification, workout, real property foreclosure, and confirmation actions, as well as borrower representation in all state and federal courts in Georgia. In addition, we represent clients in receiverships and other equitable remedies frequently brought by lenders. These attorneys also have extensive experience in preparing and reviewing commercial leases as well as a variety of corporate and partnership transaction matters, including corporate formations and the negotiation and drafting of stock sale purchase transactions.

Kaplan, Bogue & Cooper, P.C. is an approved title agent writing commercial title policies for national title insurers. This added competency allows the firm to provide an additional service to its clients that other firms farm out to third party vendors, providing an additional integrated service that helps minimize disruption in complicated commercial real estate transactions.
